!William Payne was born in Dearfield Corners, near Utica. His father died when he was two years old, and he lived with his grandfather until he was 16, attending the common schools winters and working upon the farm summers. At the age of 17 years he removed to the town of Pamelia. When 22 years of age he married Emily daughter of Alvin Herrick, of Le Ray, by whom he has had 11 children, namely: Saryette, Spencer, Almira, Edward, Adelbert Frank, Fidelia, Lucina, Adeline, Alvin, and Josephine. The last five are deceased. Spencer Payne lived at home and attended school until he arrived at the age of 17. At the age of 20 her married Fidelia, daughter of Abram Shimmel of Le Ray, and they had two sons, Herman and Clarence. For his second wife he married Mary Garner, of Orleans, in 1868 and they have one son, Elmer, and reside near the old homestead on road 55.

Jefferson County, ss. David H. Davis of Orleans, N. Y. and Bryon J Strough La Fargeville N. Y. being first duly sworn in open Court, upon their several corporeal oaths, each for himself doth dispose and say that they are subscribing witnesses to the last Will and Testament of William Payne late of the Town of Orleans in the County of Jefferson, and State of New York, deceased. And these deponents do further say that the said William Payne deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument, in writing, which is now here shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 29th day of December one thousand eight hundred and ninetyeight. That the said deceased did, at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own respective names at the end of said instrument as attesting to the execution thereof, each at the request of the said deceased, and in his presence and in the presence of each other. That the said deceased at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid was upwards of twenty-one years of age and a citizen of the United States. That he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all espects competent to devise real estate. That each of these deponents saw the other sigh his name to said instrument in the presence of said deceased.
